An Illinois appeals court has upheld the murder conviction of Melissa Calusinski, a former day care center worker, in the death of a toddler in her care. The highly contentious case began nearly a decade ago, on Jan. 14, 2009, when a toddler known as Benjamin was found unresponsive at the day care center.

Previous worker admitted during questioning that she slammed Benjamin’s head into the ground, while working at Minee Subee, Lincolnshire IL. Benjamin was taken to the hospital and x-rays showed that he suffered from head trauma. The defense argued that Calusinski’s confession was coerced. She denied all allegations against her, but was over ruled and must continue to serve a 31-year prison sentence for the death of 16-month old Benjamin Kingan.
